Planning Legislation

Under the Town and Country Planning (Environmental Impact Assessment) (England and Wales) Regulations 1999, certain types of development projects are subject to Environmental Impact Assessment (EIA).

The regulations require that a planning application for an EIA project should be accompanied by the environmental information necessary for the determining authority to make a decision.  This environmental information is submitted in the form of an environmental statement.  Planning authorities cannot grant permission for EIA developments without having first taken the environmental information into consideration.
